All 64 people on board\u00a0<a href=\"https:\/\/www.cbsnews.com\/news\/dc-plane-crash-victims-stories\/\">perished<\/a>.<\/p>\n<p>Although the cause of the accident\u00a0<u>remains<\/u>\u00a0under investigation, a report by the\u00a0<a href=\"https:\/\/www.faa.gov\/\">Federal Aviation Administration<\/a>\u00a0(FAA)\u00a0<a href=\"https:\/\/apnews.com\/article\/jet-helicopter-crash-air-traffic-controllers-caee8a1e14eb5d156725581d41e6a809\">reveals<\/a>\u00a0that the airport\u2019s staffing level at the time of the accident was \u201cnot normal,\u201d with one air traffic controller handling the work normally assigned to two people.<\/p>\n<p>Although such tragedies\u00a0<a href=\"mailto:https:\/\/www.npr.org\/2025\/01\/30\/nx-s1-5280427\/near-collisions-reagan-national-airport-military-aircraft-faa\">are<\/a>\u00a0rare, there have been many near misses involving commercial airlines in recent years. In the 2022-2023 fiscal year, the FAA\u00a0<a href=\"https:\/\/www.nytimes.com\/2025\/01\/31\/us\/plane-crash-near-misses-airlines.html?smid=url-share\">reported<\/a>\u00a0503 air control lapses that the agency categorized as \u201csignificant,\u201d representing a 65 percent increase from the previous year. Most of the close calls\u00a0<a href=\"https:\/\/www.nytimes.com\/2025\/01\/31\/us\/plane-crash-near-misses-airlines.html?smid=url-share\">occurred<\/a>\u00a0near airports with high volumes of air traffic, and they often involved errors by air controllers or pilots.<\/p>\n<p>The increasing frequency of aviation incidents\u00a0<a href=\"https:\/\/www.nytimes.com\/2025\/01\/31\/us\/plane-crash-near-misses-airlines.html?smid=url-share\">raises<\/a>\u00a0questions about flight safety. In the United States, the FAA\u00a0<a href=\"https:\/\/www.faa.gov\/regulations_policies\/faa_regulations\">regulates<\/a>\u00a0all civil aviation and sets safety standards for commercial aircraft. One of its most critical responsibilities\u00a0<a href=\"https:\/\/www.faa.gov\/about\/mission\/activities\">is<\/a>\u00a0overseeing air traffic control. The agency\u00a0<a href=\"https:\/\/www.faa.gov\/about\/mission\/activities\">develops<\/a>\u00a0air traffic rules, allocates airspace usage, and operates a national network of airport towers to ensure the safety of millions of passengers traveling through U.S. airspace each year.<\/p>\n<p>Currently, over 90 percent of the 313 air traffic control facilities in the United States\u00a0<a href=\"https:\/\/www.cbsnews.com\/news\/over-90-percent-u-s-airport-towers-understaffed-air-traffic-controllers-data-shows\/\">operate<\/a>\u00a0below FAA-recommended staffing levels. Among them, 73 facilities\u00a0<a href=\"https:\/\/www.cbsnews.com\/news\/over-90-percent-u-s-airport-towers-understaffed-air-traffic-controllers-data-shows\/\">have<\/a>\u00a0at least a quarter of the positions unfilled. To\u00a0<a href=\"https:\/\/www.nytimes.com\/2025\/01\/31\/us\/plane-crash-near-misses-airlines.html?smid=url-share\">compensate<\/a>\u00a0for these shortages, the FAA has required air traffic controllers to work extended hours.<\/p>\n<p>The staffing shortage partly\u00a0<a href=\"https:\/\/www.cnn.com\/2025\/01\/31\/us\/air-traffic-control-staffing-nationwide-problem-invs\/index.html\">stems<\/a>\u00a0from training disruptions during the COVID-19 pandemic. Becoming an air traffic controller\u00a0<a href=\"https:\/\/www.cnn.com\/2025\/01\/31\/us\/air-traffic-control-staffing-nationwide-problem-invs\/index.html\">requires<\/a>\u00a0a lengthy and rigorous certification process, and pandemic-related training pauses delayed the certification of new controllers while many experienced ones retired.<\/p>\n<p>Yet the shortage\u00a0<a href=\"https:\/\/apnews.com\/article\/jet-helicopter-crash-air-traffic-controllers-caee8a1e14eb5d156725581d41e6a809\">is<\/a>\u00a0likely to persist. The day after the D.C. plane crash, the\u00a0<a href=\"https:\/\/www.opm.gov\/\">U.S. Office of Personnel Management<\/a>\u00a0(OPM)\u00a0<a href=\"https:\/\/www.nbcwashington.com\/news\/local\/trump-administration-email-urges-federal-workers-to-take-higher-productivity-jobs\/3832294\/\">sent<\/a>\u00a0an email urging federal employees to seek \u201cmore productive\u201d jobs in the private sector. \u201cThe way to greater American prosperity is encouraging people to move from lower productivity jobs in the public sector to higher productivity jobs in the private sector,\u201d the message\u00a0<a href=\"https:\/\/www.nbcwashington.com\/news\/local\/trump-administration-email-urges-federal-workers-to-take-higher-productivity-jobs\/3832294\/\">stated<\/a>.<\/p>\n<p>In addition to the OPM communication, FAA employees also\u00a0<a href=\"https:\/\/apnews.com\/article\/jet-helicopter-crash-air-traffic-controllers-caee8a1e14eb5d156725581d41e6a809\">received<\/a>\u00a0an offer to resign with eight months\u2019 pay. If a large number of controllers\u00a0<a href=\"https:\/\/www.cnn.com\/2025\/01\/31\/us\/air-traffic-control-staffing-nationwide-problem-invs\/index.html\">accept<\/a>\u00a0the employment buyouts, the already strained workforce could shrink even further.<\/p>\n<p>Critics\u00a0<a href=\"https:\/\/apnews.com\/article\/jet-helicopter-crash-air-traffic-controllers-caee8a1e14eb5d156725581d41e6a809#:~:text=%E2%80%9CIt%20concerns%20me,before%20you%20leap.%E2%80%9D\">argue<\/a>\u00a0that the administration\u2019s efforts to downsize the federal government will only worsen the air traffic controller shortage. Losing experienced personnel amid an ongoing staffing crisis, they\u00a0<a href=\"https:\/\/apnews.com\/article\/jet-helicopter-crash-air-traffic-controllers-caee8a1e14eb5d156725581d41e6a809#:~:text=%E2%80%9CIt%20is%20not,controller%20staffing%20shortage.%E2%80%9D\">warn<\/a>, could heighten safety risks and increase the likelihood of midair collisions.<\/p>\n<p>In this week\u2019s Saturday Seminar, scholars discuss current regulations on aircraft safety.<\/p>\n<ul>\n<li>In an\u00a0<a href=\"https:\/\/scholarlypublications.universiteitleiden.nl\/access\/item%3A4150191\/view\">article<\/a>\u00a0in the\u00a0<a href=\"https:\/\/airandspacelaw.olemiss.edu\/the-journals\/journal-of-space-law\/\"><em>Journal of Space Law<\/em><\/a>,\u00a0<a href=\"https:\/\/www.universiteitleiden.nl\/en\/staffmembers\/nilgun-ozgur#tab-1\">Nilgun \u00d6zg\u00fcr<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.universiteitleiden.nl\/en\/staffmembers\/steven-truxal#tab-1\">Steven Truxal<\/a>\u00a0of the Netherlands\u2019\u00a0<a href=\"https:\/\/www.universiteitleiden.nl\/en\">Leiden University<\/a>\u00a0examine how increasing commercial space operations have created new challenges for aviation safety. \u00d6zg\u00fcr and Truxal\u00a0<a href=\"https:\/\/scholarlypublications.universiteitleiden.nl\/access\/item%3A4150191\/view#page=8\">note<\/a>\u00a0that recent growth in the space economy has led to more frequent spacecraft traffic, creating potential hazards for civil aviation and air traffic management. They\u00a0<a href=\"https:\/\/scholarlypublications.universiteitleiden.nl\/access\/item%3A4150191\/view#page=10\">suggest<\/a>\u00a0that international law is presently inadequate to address these new challenges. \u00d6zg\u00fcr and Truxal\u00a0<a href=\"https:\/\/scholarlypublications.universiteitleiden.nl\/access\/item%3A4150191\/view#page=32\">argue<\/a>\u00a0that the International Civil Aviation Organization must take a stronger role as a \u201cglobal regulatory authority\u201d to harmonize integrated airspace operations standards. A collaborative regulatory management system, \u00d6zg\u00fcr and Truxal\u00a0<a href=\"https:\/\/claude.ai\/chat\/984b7f5d-8b28-45af-884f-49b1c952b917#page=35\">conclude<\/a>, is key to achieving greater safety for both civil and space aviation.<\/li>\n<li>In an\u00a0<a href=\"https:\/\/scholar.smu.edu\/cgi\/viewcontent.cgi?article=4229&amp;context=jalc\">article<\/a>\u00a0in the\u00a0<a href=\"https:\/\/scholar.smu.edu\/jalc\/\"><em>Journal of Air Law and Commerce<\/em><\/a>,\u00a0<a href=\"https:\/\/www.researchgate.net\/profile\/Goran-Petrovic-8\">Goran Petrovi\u0107<\/a>, a lecturer at Serbia\u2019s\u00a0<a href=\"https:\/\/www.studyinserbia.rs\/in\/college-of-applied-studies-aviation-academy\">College of Applied Studies Aviation Academy<\/a>, discusses the role of and challenges facing non-governmental organizations (NGOs) in civil aviation. Petrovi\u0107\u00a0<a href=\"https:\/\/scholar.smu.edu\/cgi\/viewcontent.cgi?article=4229&amp;context=jalc#page=66\">notes<\/a>\u00a0that despite having differing views on a wide array of subjects, many civil aviation NGOs ultimately work toward a similar set of safety goals, integration of new technologies, bolstering of environmental protections, and implementation of training programs. The author\u00a0<a href=\"https:\/\/scholar.smu.edu\/cgi\/viewcontent.cgi?article=4229&amp;context=jalc#page=5\">discusses<\/a>\u00a0the United Nations\u2019\u00a0<a href=\"https:\/\/ecosoc.un.org\/en\">Economic and Social Council<\/a>, which has helped different international NGOs coordinate their activities and goals. Petrovi\u0107 also\u00a0<a href=\"https:\/\/scholar.smu.edu\/cgi\/viewcontent.cgi?article=4229&amp;context=jalc#page=65\">highlights<\/a>\u00a0how the increasing role of international NGOs reflects the increasing democratization of international law.<\/li>\n<li>In a recent\u00a0<a href=\"https:\/\/illinoislawreview.org\/wp-content\/uploads\/2023\/03\/Collareno.pdf\">article<\/a>\u00a0in the\u00a0<a href=\"https:\/\/illinoislawreview.org\/\"><em>University of Illinois Law Review<\/em><\/a>, practitioner\u00a0<a href=\"https:\/\/www.fr.com\/team\/kevin-collareno\/\">Kevin Collareno<\/a>\u00a0argues that urban air mobility (UAM), which employs short-range electric aircraft, could reinforce existing air-transportation inequities if regulators fail to act decisively. Collareno\u00a0<a href=\"https:\/\/illinoislawreview.org\/wp-content\/uploads\/2023\/03\/Collareno.pdf#page=11\">contends<\/a>\u00a0that high certification costs, strict air taxi operating rules, and an overtaxed airspace system raise expenses. High costs concentrate the benefits of air transportation systems in wealthy areas, Collareno\u00a0<a href=\"https:\/\/illinoislawreview.org\/wp-content\/uploads\/2023\/03\/Collareno.pdf#page=4\">explains<\/a>, leaving low-income and geographically peripheral communities with limited air-transportation service. Collareno\u00a0<a href=\"https:\/\/illinoislawreview.org\/wp-content\/uploads\/2023\/03\/Collareno.pdf#page=31\">urges<\/a>\u00a0lawmakers to act quickly to establish clear, predictable UAM certification procedures, create dedicated flight corridors in urban airspace, and standardize state rules for landing facilities to combat inequities before UAM technology becomes widespread.<\/li>\n<li>In an\u00a0<a href=\"https:\/\/www.kmazuckert.com\/publications\/aviation\/Silversmith\/2023\/aslv35n3.pdf\">article<\/a>\u00a0in the\u00a0<a href=\"https:\/\/www.americanbar.org\/groups\/air_space\/publications\/air_space_lawyer\/\"><em>Air &amp; Space Lawyer<\/em><\/a>, practitioner\u00a0<a href=\"https:\/\/www.linkedin.com\/in\/jolsilversmith\/\">Jol A. Silversmith<\/a>\u00a0examines the conflict between local governments and federal oversight of airport operations. Many municipalities across the country attempt to exercise control over local airports to combat perceived impacts, such as noise and environmental harms, Silversmith\u00a0<a href=\"https:\/\/www.kmazuckert.com\/publications\/aviation\/Silversmith\/2023\/aslv35n3.pdf#page=1\">observes<\/a>. Yet airports that accept federal funds must abide by grant assurances that restrict local control, and local attempts to limit late-night flights or prohibit the use of leaded fuels face preemption by various federal statutes, he\u00a0<a href=\"https:\/\/www.kmazuckert.com\/publications\/aviation\/Silversmith\/2023\/aslv35n3.pdf#page=2\">explains<\/a>. Rule<\/a>\u00a0of\u00a0<a href=\"https:\/\/law.asu.edu\/\">Arizona State University Sandra Day O\u2019Connor College of Law<\/a>\u00a0discusses the treatment of landowners\u2019 airspace rights in the United States. In recent years, Rule\u00a0<a href=\"https:\/\/moritzlaw.osu.edu\/sites\/default\/files\/2023-04\/Rule%2084-1%20FINAL.pdf#page=5\">notes<\/a>, companies such as Amazon and Walmart have pushed to override landowners\u2019 rights to control low-altitude airspace above their properties. But Rule\u00a0<a href=\"https:\/\/moritzlaw.osu.edu\/sites\/default\/files\/2023-04\/Rule%2084-1%20FINAL.pdf#page=3\">argues<\/a>\u00a0that embracing landowners\u2019 airspace rights through modern sharing platforms could help the industry achieve widespread deployment more quickly and sustainably.
